Business Mobile Data Plan ETCs and PTCs

These specific terms and conditions apply in addition to the Business Terms and Conditions, Business Account Terms & Conditions, and any other specific terms and conditions that may be applicable to a Plan under a Business Account.  (together, the Applicable Terms and Conditions).

1. These specific terms and conditions will prevail in the case of inconsistency with the Applicable Terms and Conditions.
2. Unless stated otherwise, words and phrases in these specific terms and conditions have the same meaning given to them in the Applicable Terms and Conditions.
3. Early termination charges are not subject to GST.
4. Plan transfer charges are subject to and inclusive of GST.

Early termination charges

5. Unless stated otherwise, we will require you to pay early termination charges where your fixed term Business Mobile Data Plan is terminated either by you or us in accordance with the Applicable Terms and Conditions

Business Mobile Data Plans activated on or after 21 May 2014

6. If you activated your Business Mobile Data Plan on or after 21 May 2014 these early termination charges apply to you.
7. Unless stated otherwise, we will require you to pay early termination charges where your 24 month Business Mobile Data Plan is terminated either by you or us in accordance with the Applicable Terms and Conditions.
8. The amount of the early termination charge that you will be required to pay in respect of your terminated 24 month Business Mobile Data Plan is calculated as follows:

The monthly Plan Charge of your 24 month Business Mobile Data Plan multiplied by the number of months remaining on the term of your 24 month Business Mobile Data Plan as at your final Billing Date multiplied by 40%, provided that if this amount is less than the minimum amount stated in the table below you will be required to pay the minimum amount.

For example, if you terminate your 1GB NZ Carryover Data Plan in the third month of a 24 month term, your early termination charge will be $175.98 (being $20.95 x 21 x 0.4).

However, if you terminate your 1GB NZ Carryover Data Plan with five months remaining on your 24 month term, your early termination charge will be $50, being the early termination charge minimum amount stated in the table above (due to $20.95 X 5 X 0.4 = $41.90 being lower than the minimum amount stated).

9. For the avoidance of doubt, no early termination charge applies to the termination of a Freedom Term (or month to month) Business Mobile Data Plan.

Business Mobile Data Plans activated prior to 21 May 2014

10. If you activated your Business Mobile Data Plan prior to 21 May 2014 these early termination charges apply to you.
11. Unless stated otherwise, we will require you to pay early termination charges where your 24 month term Business Mobile Data Plan is terminated either by you or us in accordance with the Applicable Terms and Conditions.
12. The amount of the early termination charge that you will be required to pay in respect of your terminated 24 month Business Mobile Data Plan is calculated as follows:

13. Unless stated otherwise, no early termination charge is applicable to the termination of a Freedom Term (or month to month) or a 12 month term Business Mobile Data Plan prior to the expiry of its fixed term.

Plan transfer charges

14. If you are on Business Mobile Data Plan, you may only transfer to another Business Mobile Data Plan, and the Plan transfer charges that will apply to such a transfer are as below.

15. No Plan transfer charge is applicable if you change a Freedom Term (or month to month) or 12 month term Business Mobile Data Plan to Freedom Term or 12 month term NZ Carryover Data Plan of a lesser Plan Charge.
16. If you wish to transfer your Business Mobile Data Plan to any other Plan or Service offered by 2degrees, your Business Mobile Data Plan will be terminated and you will be required to pay early termination charges in accordance with these terms and conditions.
