Business Fair Share Terms and Conditions

1. These terms and conditions apply to you if you signed up to a Business Fair Share (previously Business Connect) plan after 20 September 2017 and each End User under your Account.  These terms and conditions apply in addition to our standard Business Terms and Conditions, Business Account Terms and Conditions and any other terms and conditions that may apply to you.  To the extent that there is any inconsistency between any applicable terms and conditions, the more specific terms and conditions will take precedence.
2. Capitalised terms not defined in these terms have the meaning given to them in the Business Terms and Conditions or the Business Account Terms and Conditions.
3. The terms and conditions below apply when you use your Mobile Phone in New Zealand (NZ) and have subscribed to a Business Fair Share Plan.
4. Prices exclude GST, unless stated otherwise.

Business Fair Share Plan

5. Subject to these terms and conditions, you can sign up to one of the following Business Fair Share Plans on an open-term basis:
   1. Voice & Data Sharer Connection (see clauses 16 - 17); and
   2. Data Only Sharer Connection (see clauses 25 - 27).
6. Under your Business Fair Share Plan, you must have at least one Voice & Data  Sharer Connection.
7. Connections under your Account will share the allocated pool of NZ Carryover Data made available (Shared Pool). Each Connection will draw from the Shared Pool on on a first-in-first-served basis. No limit applies to an individual Connection’s use of NZ Carryover Data, and no Connection will be given priority over another Connection.
8. You will also receive automatic top up allocations of NZ Carryover Data when the total available data under your Shared Pool is exhausted in accordance with clause 13.
9. You will be charged each month a standard monthly Charge per Connection, for any automatic top allocations of NZ Carryover Data to your Shared Pool and any additional Charges where we are entitled to do under our Agreement with you.

Data allocations

10. NZ Carryover Data can only be used in NZ, unless you have paid a roaming charge enabling the use of your NZ Carryover Data by End Users in a specific roaming destination (excluding Australia).

Billing

11. The Shared Pool will be made available to you on activation of your Business Fair Share Plan. You will be charged in arrears a total amount for each Connection on your Account and single Shared Pool charge on your first Billing Date and on each Billing Date following. Any additional NZ Carryover Data added in accordance with clause 13 will also be charged in arrears.
12. If there is a balance of NZ Carryover Data remaining in your Shared Pool at the end of your billing month, that NZ Carryover Data will be carried over to the following billing month. NZ Carryover Data may be accrued for up to 12 months.
13. If your End Users exhaust the Shared Pool available during any bill month, 10GB of NZ Carryover Data will automatically be added to your Shared Pool, and you will be charged $50 for each 10GB bundle added.
14. NZ Carryover Data allocated during the bill month will be used first before any NZ Carryover Data that has been carried over from a previous month.
15. NZ Carryover Data usage per session may be rounded up to the nearest 50.84KB increment. Minimum NZ Carryover Data usage per session of up to 921.6KB applies.

Voice & Data Sharer Connection

16. You can add a Voice & Data Sharer Connection  to your Business Fair Share Plan.
17. You will be charged for each Voice & Data Sharer Connection added to your Business Fair Share Plan in accordance with your sign-up forms for your Business Fair Share Plan.

Unlimited Calling to New Zealand and Australia

18. Minutes are only valid for voice calls to any standard landline or mobile in NZ and Australia.
19. Calls are charged at a 0 cents per minute rate on each Billing Date for the term of the applicable Voice & Data Sharer Connection.
20. Unlimited Calls cannot be used to make calls to premium rate numbers (e.g. 018, 0900) or satellite phones. Calls to voicemail are included.

Unlimited Text to New Zealand and Australia

21. Texts are only valid to any standard mobile in NZ and Australia.
22. Texts will be charged at a 0 cent per text rate on each Billing Date for the term of the applicable Voice & Data Sharer Connection.
23. Unlimited Text cannot be used for MMS, texts to premium rate numbers or satellite phones.

Fair Use Policy

24. Our Fair Use Policy applies to unlimited calling and texting to NZ and Australia. For the avoidance of doubt, unlimited calls and texts must be person to person use consistent with our estimate of reasonable use of this service (referencing standard and/or estimated customer profiles). We may take action if we consider the use to be in breach of the Fair Use Policy. Please ensure that you have read and understood our Fair Use Policy, which forms part of the Business Terms and Conditions and is published by us at 2degreesmobile.co.nz/fairusepolicy.

Data Only Sharer Connection

25. You can add a Data Only Sharer Connection to your Business Fair Share Plan.
26. You will be charged for each Data Only Sharer Connection added to your Business Fair Share Plan in accordance with your sign-up forms for your Business Fair Share Plan.
27. Each Data Only Sharer Connection excludes any minutes or text entitlements, but has access to the Shared Pool in accordance with clause 7. You will be charged at our Business standard rates for calling and texting (as published on our website at 2degreesmobile.co.nz).

Changing your Plan

28. You are allowed to change the size of your Shared Pool once each month by contacting Customer Care.
29. A Connection can be changed to another type of Connection or Plan or Service offered by 2degrees (New Plan) and available under the same Business Account. We may refuse to change a Connection to a New Plan if you have not paid all of the outstanding Charges under your Business Account.

Termination of a Connection

30. You may request the termination of a Connection under your Business Account at any time in accordance with the Business Account Terms and Conditions.
31. Your Business Fair Share Plan will be terminated when you no longer have any Voice & Data Sharer Connections or Data Only Sharer Connections connected to the Business Fair Share Plan and any remaining NZ Carryover Data balances in your Shared Pool will immediately expire.

Termination of your Business Fair Share Plan

32. If you request termination of your Business Fair Share Plan, all active Voice & Data Sharer Connections and/or Data Only Sharer Connections will be terminated on your next Billing Date.
33. You must pay 2degrees all Charges incurred under your Business Fair Share Plan up to the date your Business Fair Share Plan terminates.

Add-ons and other Services

34. Add-ons that include any NZ Data cannot be purchased on any Connection.
35. You will be liable for any charges incurred for any Add-on purchased under any Connection.
