Trade In Terms
- General
- These T&Cs (in conjunction with the Pay Monthly and Interest Free Terms and Conditions) and any other applicable terms and conditions apply to Two Degrees Mobile Limited’s (2degrees) Trade In device programme (Programme).
- To be eligible to participate in the Program, the following conditions must be met by you:
- you must be an existing Pay Monthly customer at the time of trade in (including Data Sidekick and Watch Sidekick Plan);
- you must be 18 years of age or older and be legally capable of entering into a binding contract;
- you understand that by participating in this Program you are transferring ownership of the device to 2degrees;
- you must be the legal and rightful owner of the device being traded and no other third party has the right to claim interest, right or ownership of the device. The device must be free from any liens, security interest or claims by third parties; and
- the device must have been obtained by legal means and you are not trading in a lost or stolen device. In addition to 2degrees’ rights stated under clause 3, if 2degrees believes that the device has been obtained by fraudulent or otherwise illegitimate means (in its sole discretion), 2degrees reserves the right to deliver the device and your personal details to the authorities with no notice required and no liability to you.
- Device Acceptability Criteria
- Your device will be assessed by 2degrees based on 2degrees’ acceptability criteria for your device.
- If your device meets the acceptability criteria, 2degrees may offer to purchase your device at the quoted device trade in value, which is determined by 2degrees at the point of trade in based on the make, model, condition and operational nature of your device and any other considerations included in the acceptability criteria (Quoted Value).
- You acknowledge that the acceptability criteria for the trade in are subject to change and 2degrees may amend the acceptability criteria at its discretion from time to time. You will be informed of the acceptability criteria applicable to your device at the point of trade in.
- 2degrees reserves the right to decline any device that is damaged and/or does not meet 2degrees’ acceptability criteria.
- Once you have traded in your device, 2degrees will not be able to return the device.
- Your trade in credit payment
- If you choose to accept 2degrees’ offer, the Quoted Value will be deducted from the interest free value of your new device purchase or exchanged for credit towards your next post-paid 2degrees bill. If you trade in online, your Quoted Value will be credited to your bank account.
- If 2degrees finds that the trade in device has been reported lost or stolen, 2degrees will assist the police to locate the device and return it to its rightful owner and your personal details will be delivered to the police. In such instance, you agree that the Quoted Value paid by 2degrees for the lost or stolen device to you will need to be refunded in full and you authorise 2degrees to reverse the payment applied for the lost or stolen device from your 2degrees interest free contract or added to your next post-paid 2degrees bill.
- Your obligations
- You are responsible for removing the memory card, SIM card or any accessories in or on your device and erasing all the personal and confidential information and data, including, but not limited to applications, contacts and personal data, confidential and/or personal information, photos, notes, videos, messages and/or passwords from the device (Personal Information). It is also your responsibility to ensure that Personal Information in the device is appropriately backed up before handing over your device to 2degree.
- If any Personal Information has not been deleted or removed from your device, you authorise 2degrees and its partners to remove and destroy any SIM card or memory card left in the sold device and perform a factory reset and data wipe on the said device.
- Under no circumstances will 2degrees be responsible or liable for any direct or indirect loss or damage or loss of use of any Personal Information remaining in the device which you failed to remove, or which arises as a result of 2degrees or its contractor destroying or removing the Personal Information.
- You acknowledge that by accepting the Quoted Value and surrendering your device to 2degrees you are agreeing to a No Change of Mind Policy.
- Privacy Information
- You understand that any Personal Information provided in the Trade-In Authorisation form will be held by 2degrees and dealt with in accordance with 2degrees’ Privacy Policy
- 2degrees is required by law to verify your identity and obtain certain information from you including proof of identity (which may include photograph), full name, residential address, date of birth and contact details. 2degrees reserves the right to require you to provide further information required by law or the authorities.
- You acknowledge that as part of 2degrees’ licensing obligation, your Personal Information along with the device serial number may be submitted to the police data system for verification purposes and to assist with checks for lost or stolen property.
- You acknowledge that your details may be shared by 2degrees with third parties for the purposes of the Program. Please read our Privacy Policy (2degrees' Privacy Policy) for further information.
- Disabling the Apple Activation Lock
- If you have an Apple Device, you must disable the Activation Lock before trading it in. To disable the Activation Lock open settings on your device, select the iCloud section, and scroll to the “Find my iPhone” toggle and switch this to ‘off’. You can also access these options through www.icloud.com.
- Your device will not meet the eligibility acceptance criteria if the Activation Lock on the device is not disabled and 2degrees’ right in such instance will include a refund of the trade in credit, in which case 2degrees will reverse the trade in payment previously paid to your interest free contract or add it to your next post-paid bill.
- Removing Google Account
- If you have an Android Device, you must remove your Google Account before trading it in.
- Your device will not meet the eligibility acceptance criteria if your Google Account has not been removed and 2degrees’ right in such instance will include a refund of the trade in credit, in which case 2degrees will reverse the trade in payment previously paid to your interest free contract or add it to your next post-paid bill.
- General
- The trade in contract is made between you and 2degrees. In order to provide the Program, 2degrees has entered into arrangements with third party suppliers. To the maximum extent permitted at law, our third party suppliers will not be liable to you in connection with the Program. This clause is for the benefit of our Third Party Suppliers and is intended to be enforceable by them under the Contract and Commercial Law Act 2017.
- 2degrees may change these Terms and Conditions from time to time. The terms and conditions in force at the time of your device trade in will form the contract between you, 2degrees.
- Any provision of these Terms and Conditions which is invalid or unenforceable by a court is to be read down or severed to the extent of the invalidity or unenforceability, and shall not affect the validity or enforceability of that provision in another jurisdiction or of the remaining provisions.
- 2degrees’ liability under these Terms and Conditions will be limited to the Quoted Value for the Device(s) the subject of the relevant claim, and we will not be liable for any consequential loss.
- These Terms and Conditions are governed by the laws of New Zealand though second-hand goods will be dealt with in accordance with local laws and regulations in each jurisdiction. Disputes arising out of these terms or this arrangement will be settled by the courts of Auckland, New Zealand.
