Data Clock Pro Pass

  1. Application of these Terms
    1. These Data Clock Pro Pass Terms and Conditions (“Terms”) apply in addition to the 2degrees Pay Monthly Terms and Conditions, Prepay Terms and Conditions, Fair Use Policy, Data Clock Terms and Conditions, and any other applicable terms and conditions relating to your Account or Services with Two Degrees Mobile Limited (“2degrees”).
    2. Unless otherwise stated, capitalised terms not defined in these Terms have the meaning given to them in the applicable Pay Monthly Terms and Conditions, Prepay Terms and Conditions, or Data Clock Terms and Conditions.
    3. You are deemed to have accepted these Terms by purchasing or using Pro Pass in Data Clock.
  2. Definitions
    In these Terms:
    • Data Clock means the 2degrees Data Clock application.
    • Eligible Plan means an active 2degrees consumer Pay Monthly (excluding Sidekick Plans) or Prepay plan, as updated from time to time.
    • Pro Pass means the paid feature made available within Data Clock that provides access to additional Data Clock features (as set out in these terms).
    • Pro Pass Period means the 30-day period during which Pro Pass is active, starting from the date of purchase.
    • Extra Data means the additional minutes of data made available through Pro Pass.
  3. Pro Pass Features
    1. Pro Pass provides access to additional features within Data Clock during the Pro Pass Period. The features available under Pro Pass may change over time in accordance with your Agreement.
    2. Pro Pass features are only made available via Data Clock, can only be used in New Zealand, are not transferable or exchangeable, and cannot be taken as cash.
  4. Eligibility
    1. To purchase and use Pro Pass, you must:
      1. be on an Eligible Plan; and
      2. be registered on Data Clock,
        (together, an Eligible Customer).
  5. Price and Term
    1. The price of Pro Pass is as set out in Data Clock at the time of purchase.
    2. Pro Pass does not automatically renew. If you wish to continue using Pro Pass after the Pro Pass Period ends, you must purchase it again via Data Clock.
  6. Extra Data
    1. While you have an active Pro Pass, you will receive an additional allocation of data each day via Data Clock, with the relevant allocation being specified in Data Clock (or as part of a promotion) at time of purchase (“Extra Data”).
    2. Extra Data:
      1. will be provided at max speeds for 40 GB / m then reduced max speeds of 1 mps. At reduced speeds, your experience will be impacted;
      2. is only made available via Data Clock;
      3. can only be used in New Zealand;
      4. is not transferable or exchangeable, and cannot be taken as cash; and
      5. expires each day if unused.
    3. Use of Extra Data Minutes is subject to the Fair Use Policy.
  7. End of Pro Pass Period
    1. When your Pro Pass Period ends, you will no longer receive Extra Data.
    2. If your Eligible Plan ends, your Pro Pass will be suspended until you renew your Eligible Plan (or purchase another Eligible Plan) or terminate on expiry of the Pro Pass Period.
  8. Changes to Pro Pass or Terms
    1. We reserve the right to change, suspend, or terminate Pro Pass, any Pro Pass feature, or these Terms at any time in accordance with our Agreement.
